Information we collect when you sign up
“Personal information” is data that identifies, relates to, describes, can be used to contact, or could reasonably be linked directly or indirectly to you. For purposes of this Policy, there is no meaningful distinction between the terms “personal information” and “personal data.”
When you create a membership account, either as a host or a visitor, PASA will ask for the following personal information.
Personal details (such as your name, age, birthday, gender)
Contact information (such as email address, residential address, phone number)
Account information (such as login credentials, including email address and password, and account settings)
Social media data (if you choose to link your PASA account with a social media account, PASA may collect personal information such as name, age, gender, photograph, and other personal information relating to your social media account)
Billing information (such as credit, debit, or other payment card information and billing address) but only if you make a transaction.
Reviews you submit (including any screenname you publish under or any personal information you include about yourself or others in such reviews)
Content you publish through your member profile (including any personal information you include about yourself or others)
Photos of you (such as when you add a photo of yourself to your profile, upload photos to a review, or link your social media account to your PASA account)
Communications you send us (such as questions, conversations, complaints, or other information that you may submit to our support team)
Other information you may provide (including other information you provide about yourself or others through our Services or to which you provide us with access via third-party platforms)
You may choose not to provide some of the personal information described above. Please note, however, that many of our membership services require some personal information to operate, so if you choose not to provide the personal information necessary to operate and provide you with a particular feature, you may not be able to use that feature.
We do not proactively collect sensitive personal information, such as health-related information. However, our sign-up includes text boxes that are designed for you to describe certain details about your personal preferences or special requests (for example, any allergies) that you want us or our other members to know. Please be aware that information you freely submit in these boxes may reveal to us or to our other members with whom you share information, certain information that may be considered sensitive personal information under applicable law (for example, information about dietary restrictions or disability accommodations). Sensitive personal information you voluntarily submit is processed on the basis of your consent, which you may revoke at any time by contacting us on or by logging in and editing your membership.

If you do not accept all of these Terms, then you may not use Our Website. In these Terms, 'we', 'us', 'our' and 'PASA' refer to Play Away Stay Away, and 'you' and 'your' refers to you, the user of Our Website.
We may modify these Terms for any reason—at any time—by posting a new version on Our Website; these changes do not affect rights and obligations that arose prior to such changes. Your continued use of Our Website following the posting of modified Terms will be subject to the Terms in effect at the time of your use. Please review these Terms periodically for changes. If you object to any provision of these Terms or any subsequent modifications to these Terms or become dissatisfied with Our Website in any way, your only recourse is to immediately terminate use of Our Website.
1. Eligibility, Registration & Account
You must be at least 18 years old to access or use our Services. By registering to use our Services, you represent that you are at least 18 years old. In order to access the Member section of our website, you will need to register for an account using either your email address or your login credentials from a third-party social media site. If you register with your email address, you agree to create a password. By registering for an account, you further agree to (a) provide accurate, truthful, current and complete information; (b) maintain and promptly update your account information upon any changes; (c) maintain the security of your account by protecting your password and restricting access to your account; (d) promptly notify PASA if you discover or otherwise suspect any security breaches related to the Services; and (e) take responsibility for all activities that occur under your account and accept all risks of any authorised or unauthorised access.
2. Interaction with Other Members
You Have Sole Responsibility When Interacting with Other Members.
Our website provides a platform for members to learn about one another, arrange stays and engage in activities and communicate with one another. PASA is not a party to, has no involvement or interest in, makes no representations or warranties as to, and has no responsibility or liability with respect to any communications, transactions, interactions, disputes or any relations whatsoever between you and any other member, person or organisation. You are solely responsible for your interactions with other members of our Services. We reserve the right, but have no obligation, to monitor interactions between you and other members of our Services.
Remember, the PASA website is just a platform that enable you to communicate and interact with other people around the world. We cannot be responsible for the interactions that you have with other PASA members, so please use good judgement and keep safety in mind when you use our website. 3. Identity Verification.
After submitting our membership form, we personally chat to every person before they are verified to host and/or stay with other members. We confirm their validity and home address with our membership postcard (see point below) and only once this has been confirmed and we are happy with it, will we allow members to be hosts or visitors with other members. Whilst we will due our due diligence, we do not or cannot absolutely guarantee, or endorse the a member's identity or good faith. We encourage you to take precautions when interacting with other members, particularly when meeting a stranger in person for the first time. See our 'Your Safety' page for more details.
4. Address Verification
To help to ensure that the address a member submits to us is indeed their address and to eliminate any members of no-fixed-abode and therefore guarantee a minimum level of safety, we send every new member a welcome postcard to their registered street address. This is not only intended to confirm that a member actually resides at a particular address but is also one of many ways to reduce the risk of misconduct by a member and is not a guarantee of any member’s identity or good faith.
Because our Services are merely a platform, in the event that you have a dispute with one or more members, to the fullest extent permitted by applicable law you release us (and our officers, directors, members, employees, agents and affiliates) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, or in any way connected, with such disputes.
You shall defend, indemnify and hold harmless PASA (and each of our officers, directors, members, employees, agents and affiliates) from any claim, demand, action, damage, loss, cost or expense, including without limitation reasonable legal fees, arising out of or relating to (a) your use of our website; (b) any Member Content or Submissions you provide; (c) your violation of these Terms; (d) your violation of any rights of another; or (e) your conduct in connection with the website. If you are obligated to indemnify us, we will have the right, in our sole and unfettered discretion, to control any action or proceeding and determine whether we wish to settle it, and if so, on what terms.
6. Your Conduct Online
Our website includes interactive areas where you or other members can create, post or store content, messages, materials, data, information text & photos (collectively, “Member Content”). You are solely responsible for your use of such interactive areas and agree that your use of these areas is at your own risk.
6.1. Member Content Restrictions.
You are solely responsible for any Member Content that you submit, post or transmit via our Services. You agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the membership section, any content that we believe, in our sole discretion:
is unlawful, libellous, defamatory, harassing, threatening, invasive of privacy or publicity rights, or that would otherwise create liability or violate any local, state, national or international law;
contains nudity, sexually explicit content or is otherwise obscene, pornographic, indecent, lewd, suggestive or sexually exploitative of minors;
may disparage any ethnic, racial, sexual or religious group by stereotypical depiction or is otherwise abusive or inflammatory;
depicts the use of illicit drugs;
contains offensive language or images or is otherwise objectionable;
incites violence or characterises violence as acceptable, glamorous or desirable;
contains unsolicited promotions, political campaigning, advertising or solicitations, without our prior written consent;
contains private or personal information about another person, unless such person has agreed to the disclosure of this information;
contains viruses, corrupted data or other harmful, disruptive or destructive file viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology;
may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party. By posting Member Content, you represent and warrant that you have the lawful right to distribute and reproduce such Member Content; or
would constitute, encourage or provide instructions for a criminal offence or violate the rights of any third party. PASA is not responsible for any Member Content that you or other members post, transmit or store through the Services. We have no obligation to post Member Content from you or anyone else and we may, in our sole discretion, edit, remove or delete any Member Content without notice. If you become aware of Member Content that violates these Terms, you may notify us of such content by email to . Enforcement of these Terms, however, is solely in our discretion and the absence of enforcement in some instances does not waive our right to enforce the Terms in other instances. In addition, these Terms do not create a private right of action on the part of any third party or any reasonable expectation that the Services will not contain any content that is prohibited by such rules.
6.2 Member Conduct.
By accessing or using our website, you agree to act responsibly, exercise good judgement and comply with the Community Guidelines. In addition, you agree not to:
use the website in violation of any applicable law or regulation, including promoting or encouraging any illegal activity;
infringe the rights of any third party, including without limitation, intellectual property, privacy, publicity or contractual rights;
use the website in any manner that could interfere with, disrupt, negatively affect or inhibit other members from fully enjoying the website or that could damage, disable, overburden or impair the functioning of the website in any manner;
use our website in connection with the distribution of spam (which we define as unsolicited bulk e-mail or any other unsolicited messages of a commercial, religious, romantic, political or other nature not within the intended purposes of the website);
stalk, intimidate, threaten or otherwise harass or cause discomfort to any other member of our website;
collect or store any information about any other member other than as permitted on our website;
use our website for any commercial purpose whatsoever, unless with prior written consent from PASA;
register for more than one member account;
impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity, whether by providing or omitting to provide information;
circumvent or attempt to defeat any security or verification measure relating to use of our website;
hold yourself out as an agent, representative, employee or affiliate of PASA, including but not limited to, when you host other PASA members; or
assist any third party in doing any of the foregoing.
Zero tolerance Policy
Due to the nature of our business model and the high degree of personal interaction, PASA has adopted a zero-tolerance policy in terminating, in appropriate circumstances and in our sole discretion, members who are deemed to commit serious offences or infringements whether as hosts, visitors or members. PASA may also, in our sole discretion, limit access to the website and/or terminate the accounts of any members who we believe may infringe any intellectual property rights of others, whether or not there is are multiple offences.
If you are in breach of these Terms, or any other policies or community standards we have in place from time to time, we may, in our discretion at any time: (a) terminate your access to our website, (b) deactivate or delete your account and all related information and files in such account and/or (c) bar your access to any of such files or Services. In any of these instances, you are not permitted to register for another PASA account without our prior written permission.
In rare circumstances, when we feel it is necessary to protect the safety or the well being of the PASA community, we will remove a member’s account from our website. We don’t take this decision lightly, but it is sometimes required.
Administration Fee Changes
We reserve the right to adjust the administration fee levied on successful hosts exchanges in any manner and at any time as we may determine in our sole discretion. Price changes related to the administration levy will not in any way, affect members who have purchased a season-ticket for the remaining period covered by such a membership.
Paid Subscriptions automatically renew until cancelled. We will notify you if the price of a recurring subscription increases and seek your consent to continue before renewal. To request a refund, you can write to firstname.lastname@example.org. We offer refunds within 7 days of the purchase date or 30 days of the renewal date for 'Season Ticket' subscriptions.
If you interact with anyone through our website who you feel is acting or has acted inappropriately, including but not limited to offensive, violent or sexually inappropriate behaviour, who steals from you or engages in any other disturbing conduct, we strongly encourage you to immediately report such person to the appropriate authorities and to us by contacting us on . Please note that although we encourage you to report misconduct, we are not responsible or liable for our members’ actions, and we are not obligated to take any action.
In all cases of dispute, PASA will attempt to find an informal and mutually agreeable resolution before any legal action is required.
You and PASA agree to arbitrate any dispute arising from these Terms or relating to the website, except that you and PASA are not required to arbitrate any dispute in which either party seeks equitable or other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets or patents.
Subject to any rights you may have under any applicable law, arbitration prevents you from being able to thereafter pursue a lawsuit in court. You and PASA agree that you will notify each other of any dispute within thirty (30) days of when it arises, that you will attempt informal resolution prior to any demand for arbitration. Other than class procedures and remedies discussed below, the arbitrator has the authority to grant any remedy that would otherwise be available in court. Whether the dispute is heard in arbitration or in court, you an PASA will not commence against the other, a class action, class arbitration or other representative action or proceeding.
